STB Proceeding Filings
The Surface Transportation Board (STB) is an independent federal agency that regulates commercial and economic aspects of the freight rail industry as well as resolves disputes to ensure competition and efficiency in the U.S. rail network. Since 2020 the STB has been active in a variety of proceedings which have been of utmost importance and interest to the Federal Railroad Administration (FRA) and the wider Department of Transportation (DOT). The FRA & DOT have submitted various filings to STB proceeding dockets in recent years to highlight to the Board aspects of each that have implications on rail safety, fluidity and other import Department focus areas. Below are key FRA & DOT submissions to the Board.
CP-KCS Merger (FD_36500)
- Filing 304005 by DOT & FRA; submitted Feb. 28th, 2022: Administrator Amit Bose provided written satisfaction of the CPKC Safety Integration Plan (SIP) and stated that the new entity provides reasonable assurance of safety consistent with government regulations. The FRA will monitor CP’s SIP implementation and requests that the board require all conditions line out in the SIP if the merger is to be approved.
CSX PanAm-Merger (FD36472)
- Filing 302921 by DOT & FRA; submitted August 27th, 2021: DOT & FRA did not take a position for or against the merger in this filing but detailed ways the proposal will impact freight rail competition, fluidity of Northeastern passenger rail as well as safety along the affected lines.
- Filing 303094 by DOT & FRA; submitted October 18th, 2021: DOT & FRA expanded upon their initial filing further stressing to the STB the importance of evaluating potential implications on passenger rail and for the STB to include specific and enforceable conditions on the merger to support passenger rail.
- Filing 303438 by DOT & FRA; submitted Dec. 21st, 2021: Administrator Amit Bose provided a letter presenting FRA’s findings and conclusions on the CSX Pan Am merger – specifically indicating approval of CSX’s response to FRA’s safety requests and adequacy of their submitted SIP
First Mile, Last Mile (EP_767)
- Filing 303377 by DOT & FRA; submitted Dec. 17th, 2021: DOT & FRA expressed the criticality of this proceeding to the nation’s supply chain and supplied a listing of suggest indicators and numbers that are essential for the Board to track.
Reciprocal Switching (EP_711)
- Filing 303830 by DOT & FRA; submitted Feb. 14th 2022: Administrator Amit Bose provided the Board with some written advisements that any changes to requirements must consider and ensure safety and fluidity in the rail network, impacts on passenger rail, as well as efficient & cost-effective access of shippers to shippers.
- Filing 307406 by DOT & FRA, submitted Nov. 7th, 2023: Administrator Amit Bose wrote to the Board listing out important considerations to take into account while deliberating on the Reciprocal Switching NPRM decision, including: ensuring that the rule take into account rail safety impacts, not inhibit the movement of passenger rail, and promote further competition within the freight rail industry.
Urgent Issues in Freight Rail Service (EP_770)
- The Secretary of the DOT provided verbal testimony during the hearing in April 2022.
- Filing 307815 by DOT & FRA, submitted Jan 18th, 2024: FRA urged the Board to continue the reporting requirements regarding expanded employment and performance data by Class I railroads following the Urgent Issues in Freight Rail Hearing that sunset on December 31st, 2023.
Gulf Coast Amtrak Service (FD_36496)
- Filing 302296 by DOT & FRA; submitted May 10th, 2021: DOT & FRA expressed the interest of passenger rail to the Biden-Harris administration and importance of restoring passenger rail service in the Gulf Coast to combat climate change, ensure equity and drive economic vitality in the region as well as the nation.
- Filing 303355 by DOT & FRA; submitted Dec. 14th, 2021: DOT & FRA expounded upon their initial comments to the Board stressing the central role of this prceeding in DOT’s mission to advance goals of Congress and the Biden-Harris Administration. The significant funding by DOT for capital projects in the region was also mentioned.
- Filing 303912 by DOT & FRA; submitted Feb. 15th, 2022: Administrator Amit Bose provided written support of the Amtrak application for expanded rail service and impressed upon the Board the outcome of the proceeding is pivotal to future development of intercity passenger rail in the U.S.
