Operating Practices
FRA's Operating Practices staff examine railroad operating rules, employee qualification guidelines, and training and testing programs to determine compliance with the Railroad Safety Act of 1970, the Hours of Service Act, and relevant sections of Title 49 Code of Federal Regulations.
FRA Review of Railroad Certification Decisions
The Operating Crew Review Board (OCRB or Board) was established under 49 CFR Parts 240 and 242. The OCRB reviews petitions submitted by current and prospective locomotive engineers and conductors who are challenging a railroad’s decision to deny their certification or recertification, or to revoke their certification. After the Board issues its decision on a matter, further FRA review of the certification decision is available by an Administrative Hearing Officer (AHO) and by the FRA Administrator. For answers to frequently asked questions about FRA review of railroad certification decisions (including the processes for requesting review by the OCRB, the AHO, and the FRA Administrator), please review Guidance Explaining the Federal Railroad Administration’s Dispute Resolution Procedures For Locomotive Engineer and Conductor Certification FAQs.
